Applies to: Zyntriq Dispatch, together with its associated website, applications, and dashboards (the “Service”).

1. Scope

This Privacy Policy explains how Motus Labs LLC collects, uses, discloses, and protects personal information in connection with Zyntriq Dispatch. It applies to visitors, registered users, dispatchers, technicians, and other individuals whose information we process in connection with the Service.

3. Purposes for Processing

We process personal information to: (a) provide, maintain, and improve the Service; (b) process subscription billing; (c) power dispatch routing and scheduling features; (d) communicate with you about your account, billing, or support requests; (e) detect, investigate, and prevent fraud, abuse, and security incidents; (f) comply with legal, tax, and regulatory obligations; and (g) with consent or as otherwise permitted, for marketing communications.

4. Legal Bases for Processing (GDPR)

Where the GDPR applies, we rely on the following legal bases: performance of a contract (providing the Service you sign up for); legitimate interests (security, fraud prevention, product improvement), balanced against your rights; consent (e.g., certain cookies and marketing); and legal obligation (e.g., tax recordkeeping).

5. Data Retention

We retain personal information for as long as needed to provide the Service and for legitimate business or legal purposes, generally as follows: account and usage data for the duration of your account plus up to 24 months thereafter; dispatch logs for up to 12 months unless a longer period is required for a specific customer engagement or legal hold. We securely delete or anonymize data when it is no longer needed, subject to legal retention requirements.

6. Third-Party Service Providers and Integration Partners

We share personal information with service providers who process it on our behalf, including cloud hosting and infrastructure providers, database and backend providers, mapping/routing providers, and messaging/notification providers used to power dispatch alerts. These providers are contractually restricted to using data only to provide services to us, consistent with our Data Processing Agreement. We do not sell personal information to third parties for their own marketing purposes.

7. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, and similar technologies to operate the Service, remember preferences, measure usage, and (where applicable) support advertising. You can control cookies through your browser settings and, where required, through an on-site cookie consent tool. Disabling certain cookies may limit functionality.

8. Disclosure of Information

We may disclose personal information: to service providers as described above; to comply with law, subpoena, or legal process; to protect the rights, property, or safety of Motus Labs, our users, or others; in connection with a merger, acquisition, financing, or sale of assets; and with your consent.

GDPR/UK GDPR (EEA/UK residents): You have the right to access, rectify, erase, or restrict processing of your personal information; to data portability; to object to processing based on legitimate interests or for direct marketing; and to withdraw consent at any time. You may lodge a complaint with your local data protection authority.

CCPA/CPRA (California residents): You have the right to know what personal information we collect and how we use it, to request deletion, to correct inaccurate information, to opt out of the sale or sharing of personal information (Motus Labs does not sell personal information), and to be free from discrimination for exercising these rights. You may designate an authorized agent to submit requests on your behalf.

10. International Data Transfers

Where personal information is transferred across borders (for example, from the EEA/UK to the United States), we rely on appropriate safeguards such as Standard Contractual Clauses or other recognized transfer mechanisms.

11. Data Security

We implement administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and vendor security review. No system is perfectly secure, and we cannot guarantee absolute security.

12. Children’s Privacy

The Service is not directed to children under 13 (or under 16 where applicable local law sets a higher age for consent), and we do not knowingly collect personal information from children in that age range. If we learn we have collected information from a child in violation of this Section, we will delete it.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version with a new effective date and, for material changes, provide additional notice as described in our Terms of Service.
